Dispute Payment Terms

  1. Dispute Payment Initiation
    By engaging with our services, the Client agrees that if a dispute payment is raised with the payment gateway provider (such as a chargeback or payment reversal), it shall be considered as a voluntary termination of the service provided by us.
  2. Termination of Service
    Upon the initiation of a payment dispute, the Client acknowledges and agrees that all services provided by us will be considered terminated immediately without the need for any additional request for backup data, retrieval, or continued service. The Client forfeits any rights to recover, access, or retain data associated with the service, including but not limited to, backup files or records of service usage.
  3. Security and Data Access
    We reserve the right to investigate any server data, logs, and related activities for security and fraud prevention purposes. This includes the right to analyze any data related to the disputed payment and to safeguard the integrity of our systems.
  4. Exclusion of Support and Liability
    Following the initiation of a dispute, we are under no obligation to provide ongoing support to the Client. The Client agrees that once a payment dispute has been raised, we are not responsible for resolving any technical issues, providing assistance, or addressing any outstanding requests.
  5. No Refund Responsibility
    The Client acknowledges that any dispute regarding the refund or lack thereof, whether the Client receives a refund or not, is a matter between the Client and the payment gateway provider. We shall not be held responsible for any financial losses or the outcome of such disputes, regardless of whether the matter is escalated to an international court of law or any other legal body.
  6. Liability Disclaimer
    In the event the Client does not receive a refund after raising a dispute, the Client agrees to pursue all claims directly with the payment gateway provider. We disclaim any responsibility or liability, whether under contract, tort, or any other legal theory, for outcomes arising from disputes or failure to secure a refund, including any matters involving international courts.
  7. Indemnity
    The Client agrees to indemnify, defend, and hold harmless Visual Idea Network, its employees, agents, and affiliates from any and all claims, damages, losses, and liabilities arising out of or in connection with any payment dispute, chargeback, or legal proceeding related to a payment dispute, including any actions taken by the payment gateway provider.
  8. Governing Law
    These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles. The Client agrees that any legal proceedings related to this agreement shall be brought exclusively before the competent courts of Malaysia, unless otherwise agreed.
  9. Amendments to Terms
    We reserve the right to modify or amend these terms and conditions at any time without period notice.
